Terms of Service and Membership

The Dairy Hub utilises technologies and services that enable people to connect with each other, build communities, and share learnings. These Terms govern your use of the Dairy Hub and the other products, features, apps, services, technologies, and software we offer, except where we expressly state that separate terms (and not these) apply.

We don’t charge you to use the Dairy Hub or the other products and services covered by these Terms.  We don’t sell your personal data to advertisers, and we don’t share information that directly identifies you (such as your name, email address or other contact information) with advertisers unless you give us specific permission.

Our Privacy Policy explains how we collect and use your personal data. You can also go to your profile settings at any time to review the privacy choices you have selected and to review how we use your data.

1. The services we provide

Our mission is to give people the power to build a community of practice and bring the world closer together. To help advance this mission, we provide the Products and services described below to you as a personalized experience for you. Your experience on the Dairy Hub is unlike anyone else’s: from the posts, stories, events, and other content you see in News Feed or our video platform to the Profiles you follow and other features you might use.

We use the data we have, for example, about the connections you make, the choices and settings you select, and what you share and do on and off our Products, to personalize your experience. Through the Dairy Hub, we connect you with people and organizations you care about: We help you find and connect with people, groups, businesses, organizations, and others that matter to you across the Dairy Hub site. We use the data we have to make suggestions for you and others – for example, groups to join, events to attend, Profiles to follow or send a message to, and people you may want to connect with.

Stronger ties make for better communities, and we believe our services are most useful when people are connected to people, groups, and organizations they care about. We aim to empower you to express yourself and communicate about what matters to you: There are many ways to express yourself on Dairy Hub and to communicate with others about what matters to you – for example, sharing status updates, photos, videos, and documents across the Dairy Hub you use, sending messages to a friend or several people, creating events or groups, or adding content to your profile.

People will only build a community on the Dairy Hub if they feel safe. We employ a dedicated team and develop advanced technical systems to detect misuse of our Products, harmful conduct towards others, and situations where we may be able to help support or protect our community. If we learn of content or conduct like this, we will take appropriate action – for example, offering help, removing content, removing or restricting access to certain features, disabling an account, or contacting law enforcement. We share data with other companies when we detect misuse or harmful conduct by someone using one of our Products and we develop automated systems to improve our ability to detect and remove abusive and dangerous activity that may harm our community and the integrity of our Products.

In addition, we research ways to make our services better. We engage in research to develop, test, and improve our Products. This includes analyzing the data we have about our users and understanding how people use our Products, for example by conducting surveys and testing and troubleshooting new features. Our Privacy Policy explains how we use data to support this research for the purposes of developing and improving our services. Our Products help you find and connect with people, groups, businesses, organizations, and others that are important to you. We design our systems so that your experience is consistent and seamless across the Dairy Hub. To operate our global service, we need to store and distribute content and data in our data centers and systems around the world, including outside your country of residence. This infrastructure may be operated or controlled by the hub representatives or its affiliates.

2. Your commitments to the hub and our community

We provide these services to you and others to help advance our mission. In exchange, we need you to make the following commitments: 1. Who can use our Dairy Hub. When people stand behind their opinions and actions, our community is safer and more accountable. For this reason, you must:

• Use the same name that you use in everyday life.
• Provide accurate information about yourself.
• Create only one account (your own) and use your timeline for personal purposes.
• Not share your password, give access to your account to others, or transfer your account to anyone else (without our permission).

2. What you can share and do on the Dairy Hub. We want people to use the Dairy Hub to express themselves and to share content that is important to them, but not at the expense of the safety and well-being of others or the integrity of our community. You therefore agree not to engage in the conduct described below (or to facilitate or support others in doing so):

1. You may not use our Products to do or share anything:
   • That violates these Terms, our Community Standards, and other terms and policies that apply to your use of the hub.
   • That is unlawful, misleading, discriminatory or fraudulent.
   • That infringes or violates someone else’s rights, including their intellectual property rights.
2. You may not upload viruses or malicious code or do anything that could disable, overburden, or impair the proper working or appearance of our Products.
3. You may not access or collect data from our Products using automated means (without our prior permission) or attempt to access data you do not have permission to access.

We can remove or restrict access to content that is in violation of these provisions. If we remove content that you have shared in violation of our Community Standards, we’ll let you know and explain any options you have to request another review, unless you seriously or repeatedly violate these Terms or if doing so may expose us or others to legal liability; harm our community of users; compromise or interfere with the integrity or operation of any of our services, systems or Products; where we are restricted due to technical limitations; or where we are prohibited from doing so for legal reasons. To help support our community, we encourage you to report content or conduct that you believe violates your rights (including intellectual property rights) or our terms and policies. We also can remove or restrict access to your content, services or information if we determine that doing so is reasonably necessary to avoid or mitigate adverse legal or regulatory impacts to the dairy hub

The permissions you give us. We need certain permissions from you to provide our services:

1. Permission to use content you create and share: Some content that you share or upload, such as photos or videos, may be protected by intellectual property laws. You own the intellectual property rights (things like copyright or trademarks) in any such content that you create and share on the dairy hub. Nothing in these Terms takes away the rights you have to your own content. You are free to share your content with anyone else, wherever you want. However, to provide our services we need you to give us some legal permissions (known as a ‘license’) to use this content. This is solely for the purposes of providing and improving our Products and services as described in Section 1 above. Specifically, when you share, post, or upload content that is covered by intellectual property rights on or in connection with our Products, you grant us a non-exclusive, transferable, sub-licensable, royalty-free, and worldwide license to host, use, distribute, modify, run, copy, publicly perform or display, translate, and create derivative works of your content (consistent with your privacy and application settings). This means, for example, that if you share a photo you give us permission to store, copy, and share it with others (again, consistent with your settings) such as service providers that support our service. This license will end when your content is deleted from our systems. You can delete content individually or all at once by deleting your account. 
2. Contact us if you need assistance with how to delete your account. You can download a copy of your data at any time before deleting your account. When you delete content, it’s no longer visible to other users, however it may continue to exist elsewhere on our systems where:
   • immediate deletion is not possible due to technical limitations (in which case, your content will be deleted within a maximum of 90 days from when you delete it);
   • your content has been used by others in accordance with this license and they have not deleted it (in which case this license will continue to apply until that content is deleted); or
   • where immediate deletion would restrict our ability to:
     • investigate or identify illegal activity or violations of our terms and policies (for example, to identify or investigate misuse of our Products or systems);
     • comply with a legal obligation, such as the preservation of evidence; or
     • comply with a request of a judicial or administrative authority, law enforcement or a government agency;
3. Permission to update software you use or download: If you download or use our software, you give us permission to download and install updates to the software where available.

4. Limits on using our intellectual property. If you use content covered by intellectual property rights that we have and make available in our Products (for example, images, designs, videos, or sounds we provide that you add to content you create or share on the hub, we retain all rights to that content (but not yours). You can only use our copyrights or trademarks (or any similar marks) a with our prior written permission. You must obtain our written permission (or permission under an open source license) to modify, create derivative works of, decompile, or otherwise attempt to extract source code from us.

4. Additional provisions

1. Updating our Terms. We work constantly to improve our services and develop new features to make the Dairy Hub better for you and our community. As a result, we may need to update these Terms from time to time to accurately reflect our services and practices. Unless otherwise required by law, we will notify you before we make changes to these Terms and give you an opportunity to review them before they go into effect. Once any updated Terms are in effect, you will be bound by them if you continue to use our Products. We hope that you will continue using our Products, but if you do not agree to our updated Terms and no longer want to be a part of the Dairy Hub community, you can delete your account at any time. 2. Account suspension or termination. We want the Dairy Hub to be a place where people feel welcome and safe to express themselves and share their thoughts and ideas. If we determine that you have clearly, seriously or repeatedly breached our Terms or Policies, including in particular our Community Standards, we may suspend or permanently disable access to your account. We may also suspend or disable your account if you repeatedly infringe other people’s intellectual property rights or where we are required to do so for legal reasons. Where we take such action we’ll let you know and explain any options you have to request a review, unless doing so may expose us or others to legal liability; harm our community of users; compromise or interfere with the integrity or operation of any of our services, systems or Products; or where we are restricted due to technical limitations; or where we are prohibited from doing so for legal reasons. You can contact us to learn more about what you can do if your account has been disabled and how to contact us if you think we have disabled your account by mistake. If you delete or we disable your account, these Terms shall terminate as an agreement between you and us, but the following provisions will remain in place: Limits on liability. We work hard to provide the best Products we can and to specify clear guidelines for everyone who uses them. Our Products, however, are provided “as is,” and we make no guarantees that they always will be safe, secure, or error-free, or that they will function without disruptions, delays, or imperfections. To the extent permitted by law, we also DISCLAIM ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not control or direct what people and others do or say, and we are not responsible for their actions or conduct (whether online or offline) or any content they share (including offensive, inappropriate, obscene, unlawful, and other objectionable content).We cannot predict when issues might arise with our Products. Accordingly, our liability shall be limited to the fullest extent permitted by applicable law, and under no circumstance will we be liable to you for any lost profits, revenues, information, or data, or consequential, special, indirect, exemplary, punitive, or incidental damages arising out of or related to these Terms or the Dairy Hub, even if we have been advised of the possibility of such damages.

4. Other

1. These Terms make up the entire agreement between you and the Dairy Hub regarding your use of our Products. They supersede any prior agreements.
2. Some of the Products we offer are also governed by supplemental terms. If you use any of those Products, supplemental terms will be made available and will become part of our agreement with you. For instance, if you access or use our Products for commercial or business purposes, such as buying ads, selling products, developing apps, managing a group or profile for your business, or using our measurement services, you must agree to our Terms. If you post or share content containing music, you must comply with our Music Guidelines. To the extent any supplemental terms conflict with these Terms, the supplemental terms shall govern to the extent of the conflict.
3. If any portion of these Terms is found to be unenforceable, the remaining portion will remain in full force and effect. If we fail to enforce any of these Terms, it will not be considered a waiver. Any amendment to or waiver of these Terms must be made in writing and signed by us.
4. You will not transfer any of your rights or obligations under these Terms to anyone else without our consent.
5. These Terms do not confer any third-party beneficiary rights. All of our rights and obligations under these Terms are freely assignable by us in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise.
6. You should know that we may need to change the username for your account in certain circumstances (for example, if someone else claims the username and it appears unrelated to the name you use in everyday life).
7. We always appreciate your feedback and other suggestions about our products and services. But you should know that we may use them without any restriction or obligation to compensate you, and we are under no obligation to keep them confidential.
8. We reserve all rights not expressly granted to you.

5. User Accounts/Memberships

Whether you register an account on the Service or use the Service without registering an account, you may access the Service and functionality that we may establish and maintain from time to time and in our sole discretion subject to this Agreement.  We may maintain different types of accounts (“User Accounts”) for different types of Users.  To access certain features or areas of the Service, you may be required to provide personal and/or demographic information as part of a registration or login process.  We may reject, or require that you change, any user name, password, or other information that you provide to us in registering.  By connecting to the Service through a third-party service (such as a social media platform), you give us permission to access and use your information from that service as permitted by that service and to store your log-in credentials for that service.

You may never use another Users’ User Account without permission.  When creating your User Account, you must provide accurate and complete information, and you must keep this information up to date (this includes your contact information, so that we can reliably contact you).  You are solely responsible for the activity that occurs on your User Account, and if you are required to provide a password for your User Account, you must keep it secure.  You must notify the Dairy Hub immediately of any breach of security or unauthorized use of your User Account.  The Dairy Hub will not be liable for any losses caused by any unauthorized use of your User Account.

By providing the Dairy Hub team your email address and other contact information, you consent to us using such contact information to send you Service-related notices by email, or any other contact form you may provide us with (including your phone number for calls or text messages), and you agree to receive such notices. The Dairy Hub is not responsible or liable for any loss, injury, or claim of any kind resulting from your failure to receive or read these communications, or from your failure to comply with any recommendations contained in these communications.

6. Changes to the Service

We may, without notice and liability, change the Service, stop providing the Service or certain features of the Service, to you or to Users generally, or create usage limits for the Service. We may permanently or temporarily terminate or suspend your access to the Service without notice and liability for any reason, including if, in our sole determination, you violate any provision of this Agreement, or for no reason.

7. Promotions

Any sweepstakes, contests, raffles, surveys, games, or similar promotions (collectively, “Promotions”) made available through the Service may be governed by rules that are separate from this Agreement.  If you participate in any Promotions, please review the applicable rules as well as our Privacy Policy.  If the rules for a Promotion conflict with this Agreement, the Promotion rules will govern.

8. Service Location

The Service is controlled and operated from facilities in the European Union. The Dairy Hub makes no representations that the Service is appropriate or available for use in jurisdictions other than the jurisdictions where the Dairy Hub has made the Service available. Those who access or use the Service from other jurisdictions do so at their own volition and are entirely responsible for compliance with all applicable and local laws and regulations, including but not limited to export and import regulations. Unless otherwise explicitly stated, all materials found on the Service are solely directed to individuals, companies, or other entities located in the EU.

Privacy Policy

The Dairy Learning Hub (“us”, “we”, or “our”) operates the https://dairylearninghub.com website (the “Service”). A visitor or end user of our Services shall be referred to as “you”, “your(s)” or “yourself”.

This page informs you of our policies regarding the collection, use, and disclosure of Personal Data when you use our Service and the choices you have associated with that data.

• Terms. Shall mean our Terms and Conditions of Service, accessible from https://dairylearninghub.com.

Lastly, the terms “collect”, “process”, “treat”, “use”, “share”, “disclose”, “divulge” and analogous words shall refer to Personal Data and other information collected from our visitors and end users.

User Agreement & Registration

As a user of our Services, you will be asked to agree to this Policy by clicking on the “I Agree” checkbox on the registration form, pop-up box or other analogous means.  Through that action, you thereby acknowledge and agree to the terms of this Policy, which is and constitutes a legal, binding agreement between you and The Dairy Learning Hub.

Overall, this Policy is freely available for your review prior to registration, and if you do not agree to its terms, your remedy shall consist of not registering an account, and exiting the web tab through which you visited our Site.

For purposes of this Policy, our websites shall be the initial point of contact between you and The Dairy Learning Hub, and will serve as the point of collection of any personal data you may provide us.

Accordingly, by registering with us and/or otherwise using our products and services, you consent to the collection, transfer, processing, storage, and disclosure of your Personal Data as described in this Policy.

Information Collection and Use

We collect several different types of information for various purposes to provide and improve our Service to you.

Types of Data Collected

Personal Data

While using our Service, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you (“Personal Data”).  Personally identifiable information may include, but is not limited to:

We may also collect information how the Service is accessed and used (“Usage Data”). We may also collect single-pixel GIFs, clear GIFs, invisible GIFs, and 1-by-1 GIFs; which are smaller than cookies and tell our server information such as the IP address and browser type related to the visitor’s device.

We may also collect “log files,” “server logs”, “clickstream” data and “Internet Tags”; which are used for system management, to improve the content of our websites, market research purposes, and to communicate information to visitors.

Personal Data Collected via Service Providers

We may allow our users to use third party Service Providers integrations such as WordPress, Facebook, Google and others (if available).  Our platform might also provide an option of using your social media credentials and, thus, by such action, we will collect your Personal Data as given by such third party platforms, but never more than the Personal Data these platforms disclose.  

Collected Personal Data from such third parties will include, but will not be limited to, friend lists, email, image gallery, likes and other information.  If you close your social media account, or if you deauthorize our access, your access to our websites may be suspended.  For more information, please read the terms and policies of such third party platforms.  Please take into account that such third party social media platforms may disclose and share your personal information according to their own rules, guidelines and policies.

Tracking & Cookies Data

We use cookies and similar tracking technologies to track the activity on our Service and hold certain information.

We may also collect and use the data contained in log files, which may include your IP address, your ISP, the browser you used to visit our platform, the time you visited our platform and which sections you visited.

When you access our platform via a mobile device, we may use your mobile device ID (i.e. the unique identifier assigned to a mobile device by the manufacturer) and/or Advertising ID (for Apple iOS) instead of cookies in order to recognize you and track displayed web pages, along with their performance.  For the latest versions of Apple iOS, your device would request you one or more times for your express consent for advertising tracking.

Use of Data

The Dairy Learning Hub uses the collected data for various purposes:

• To monitor the usage of our Service

Legal Basis for Processing Personal Data Under General Data Protection Regulation (GDPR)

If you are from the European Economic Area (EEA), the legal basis for collecting and using the personal information described in this Privacy Policy depends on the Personal Data we collect and the specific context in which we collect it.

The Dairy Learning Hub may process your Personal Data because:

• We need to perform a contract with you
• You have given us permission to do so
• The processing is in our legitimate interests and it’s not overridden by your rights
• For payment processing purposes
• To comply with the law

Retention of Data

The Dairy Learning Hub will retain your Personal Data only for as long as is necessary for the purposes set out in this Policy. We will retain and use your Personal Data to the extent necessary to comply with our legal obligations (for example, if we are required to retain your data to comply with applicable laws), resolve disputes, and enforce our legal agreements and policies.

The Dairy Learning Hub will also retain Usage Data for internal analysis purposes. The Dairy Learning Hub will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.

Disclosure of Data

Disclosure to Affiliates and Partners

We will need to share your data with third-party vendors, service providers, contractors or agents who perform services for us or on our behalf and require access to such information to do that work.  This information may be used to, among other things, analyze and track data, determine the popularity of certain content, pages or features, and better understand online activity.

Public Domain

In addition, any of your submitted user generated content may be indexed by search engines.

Vital Interests

We may disclose your information where we believe it is necessary to investigate, prevent, or take action regarding potential violations of our policies, suspected fraud, situations involving potential threats to the safety of any person and illegal activities, or as evidence in litigation in which we are involved.

Disclosure for Law Enforcement

Under certain circumstances, The Dairy Learning Hub may be required to disclose your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

Legal Requirements

The Dairy Learning Hub may disclose your Personal Data in the good faith belief that such action is necessary to:

Commercial Message Communications

In certain circumstances, you have the following data protection rights:

• The right to be forgotten. You can request us to be “forgotten”; that is, to have your entire Personal Data removed from our service.  If we are asked to do this, in accordance with Article 17 GDPR we will remove any Personal Data that we have collected from you as requester.  We will also need to contact any third parties that process your Personal Data on our behalf, such as our cloud service providers.  To ensure that any personal data in The Dairy Learning Hub’s possession can be removed in a timely manner, you can relay any request to be “forgotten” to us by submitting a request.
• The right to access, update or to delete the information we have on you. As a data subject, in accordance with Article 15 GDPR you can ask The Dairy Learning Hub to confirm how and where your Personal Data is being stored and processed. Whenever made possible, you can access, update or request deletion of your Personal Data directly within your account settings section. If you are unable to perform these actions yourself, please contact us to assist you. You also have the right to know how such that data is shared with third parties by us.
• The right of rectification. in accordance with Article 16 GDPR you have the right to obtain from The Dairy Learning Hub, without undue delay, the rectification of inaccurate Personal Data concerning you if that information is inaccurate or incomplete.
• The right to object. You have the right to object to our processing of your Personal Data.
• The right of restriction. You have the right to request that we restrict the processing of your personal information.
• The right to data portability. Under the GDPR, in accordance with Article 20 GDPR our users located in the EU may request The Dairy Learning Hub to send them any Personal Data in our possession. In this case, we will provide you with any Personal Data that you have in a commonly used, structured and machine-readable format.
• The right to withdraw consent. In accordance with Article 7 (3) GDPR, you have the right to withdraw your consent given to us at any time where The Dairy Learning Hub relied on your consent to process your personal information.

Your privacy request must include, at the least, the following information: (i) your complete name, address and/or e-mail address in order for us to notify you the response to your request; (ii) attached documents establishing your identity; and (iii) a clear and concise description of the Personal Data with regard to which you seek to enforce any of your privacy rights.  If you request rectification, please indicate amendments to be made and attach documentation to back up your request.

Upon receipt of your privacy request, and after due review, we may then edit, deactivate and/or delete your Personal Data from our Services for the maximum term allowed by the GDPR on each applicable case.  In case of secure databases under our control where deletion is impossible, we will make such information permanently inaccessible.

Service Providers

We may employ third party Service Providers (both companies and individuals) to facilitate our Service, to provide the Service on our behalf, to perform Service-related services or to assist us in analyzing how our Service is used.

We may use third-party Service Providers to monitor and analyze the use of our Service.

• Google Analytics. Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network. You can opt-out of having made your activity on the Service available to Google Analytics by installing the Google Analytics opt-out browser add-on. Payments

We may provide paid products and/or services within the Service. In that case, we use third-party services for payment processing (e.g. payment processors).

We will not store or collect your payment card details.
